MLSpulse System PRIVACY STATEMENT AND POLICY

Xtensible and/or the real estate professional or mortgage professional may gather information about Web site visitors to improve the caliber of online information and services offered on the MLSpulse System (the “System”). By using the System, you signify your assent to this Privacy Statement and Policy. If you do not agree to this Privacy Statement and Policy, please do not use the System. Your continued use of the System following the posting of changes to these terms will mean you accept those changes. If there is suspected unauthorized use or misuse of the System, such as data scraping of the Multiple Listing Service ("MLS") data or access by an Internet "robot", the System will gather detailed information about the User for the purpose of reporting such activity to the MLS information provider and to prevent future access to the System. There are three forms of data that the System collects: (1) site visitor data, (2) personal information voluntarily provided to us by site visitors or users, and (3) additional user data in the case of suspected unauthorized use or misuse of the MLS data or System. The System may gather data on Web site activity, such as how many people visit the site, the pages they visit, how long they stay, etc. in order to monitor services provided. Site visitor data is collected on an aggregate, anonymous basis, which means no personal information is associated with this data. Anonymous information such as when the System was last accessed, number of logons, number of searches, etc. is collected. Xtensible may share such aggregate information with third parties, including real estate professionals and mortgage professionals. The User is required to provide a valid e-mail address of the User as a minimum requirement in order for the System to define a unique User log-in identity and provide email based notification of property matches or showing request confirmations. Personal information such as the visitor's or user's name, address, and phone number is not required and is voluntarily provided by the User. This information is viewable by the real estate professional and mortgage professional/s assigned to the User’s MLSpulse account. The System, at the User's discretion, optionally captures any alerts, property listings and comments saved by the User in their portfolio as well as calendar events. The User's portfolio is viewable by an assigned real estate professional associated with the web site through which the User gained access. It accomplishes this by enabling the assigned real estate professional to view the User's portfolio, alerts, property watch preferences, calendar and property showing requests. The System also collects statistics on User activity and usage, such as User logons, # of searches, last logon, etc. The mortgage professional/s assigned to a User’s MLSpulse account have access to the User’s calendar and can communicate with the User through the MLSpulse communication system (desktop alerts, email, shared notes and calendaring). Other personal Information is collected through requests for information, updates, services and requests for contact. The real estate professional or mortgage professional/s or their respective organizations, or office or Xtensible personnel use this other personal information and the personal and statistical information listed above, in order to provide the requested service, to assist the User through their home shopping experience and to make the User aware of services offered by the real estate professional or mortgage professional/s. On occasion, this information may be used by the real estate professional or mortgage professional/s, organization, office or Xtensible to request a survey regarding the service provided. The System employs methods to detect and prevent unauthorized access and/or misuse of proprietary or confidential information. Specifically, user Log-In information and/or IP addresses are checked for user authentication purposes. Additional checks may also be employed. If the System detects possible unauthorized use of the MLS information or the System, the following information will be gathered and reported to Xtensible and the MLS information provider: the suspected offending system's IP Address, information that is available via HTTP headers, and information with regard to the real estate professional through whom the User gained access. Xtensible will not rent or sell the information contained within the System to anyone. Xtensible may share personal information with real estate professionals or mortgage professional/s as described above, but will not share your personal information with any other third parties without your knowledge except that Xtensible may (i) disclose that information to third parties when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with our rights or property, other members or users of the System, or anyone else that could be harmed by such activities, (ii) disclose that information to third parties when we believe in good faith that the law requires it; and (iii) transfer such information to successors of our business assets. On rare occasions it may be necessary to send out a service related announcement. For instance, if our service is temporarily suspended for maintenance we might send users an email or an alert. Generally, users may not opt-out of these communications. They are not promotional in nature. Either the real estate professional/mortgage professional/MLSpulse vendors/organization/office or Xtensible may provide links to other web sites. These other sites are not bound by the terms of this privacy policy and we assume no responsibility for the information practices of those sites. We encourage you to review the privacy policy of such sites before disclosing any personally identifying information. |
